We reserve the right to update, change, or replace any part of these Terms at any time. It is your responsibility to check this page periodically for changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

2. Description of Service

Staqc is a health and wellness tracking platform that allows users to:

  • Track biomarkers, supplements, diets, fitness routines, and effects
  • Generate AI-powered health recommendations based on personal data
  • Interact with an AI chat assistant for health-related questions
  • Share posts, comments, and engage with a community
  • Access community insights and aggregated health data

3. User Accounts and Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and identification
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You may register using email/password or through Google OAuth. You are responsible for maintaining the confidentiality of your account credentials.

4. User Conduct and Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any harmful, offensive, or inappropriate content
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Share your account credentials with others
  • Use the Service to provide medical advice or diagnosis to others

5. Health Information and Medical Disclaimer

IMPORTANT: The Service is for informational and tracking purposes only. It is NOT intended to:

  • Diagnose, treat, cure, or prevent any disease or medical condition
  • Replace professional medical advice, diagnosis, or treatment
  • Constitute a medical consultation or establish a doctor-patient relationship

You should always seek the advice of qualified health providers with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information provided by the Service.

AI-generated recommendations are based on patterns in data and should not be considered medical advice. Always consult with healthcare professionals before making significant changes to your health regimen.

6. User-Generated Content

You retain ownership of content you post, upload, or submit to the Service ("User Content"). By posting User Content, you grant us:

  • A worldwide, non-exclusive, royalty-free license to use, reproduce, and display your User Content on the Service
  • The right to use anonymized, aggregated data from your User Content for community insights and platform improvement

You are solely responsible for your User Content and represent that you have all necessary rights to post it. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

7. AI Services and Data Processing

Our Service includes AI-powered features (chat and recommendations) that process your health data. By using these features:

  • You explicitly consent to the processing of your anonymized health data by third-party AI services (OpenRouter)
  • You understand that AI responses are generated and may contain errors or inaccuracies
  • You acknowledge that AI recommendations are not medical advice
  • You can withdraw consent at any time by disabling AI features

Separate consent is required for chat AI and recommendation AI features. You can accept or decline each independently.

8. Subscriptions and Payments

The Service offers both free and premium subscription tiers. Premium subscriptions may be purchased through:

  • Apple Store: For iOS app users, subscriptions are managed through Apple's in-app purchase system and are subject to Apple's terms and conditions
  • Stripe: For web users, payments are processed through Stripe and are subject to Stripe's terms of service

Subscription terms:

  • Subscriptions automatically renew unless cancelled
  • You can cancel your subscription at any time through your account settings or the respective payment platform
  • Cancellation takes effect at the end of the current billing period
  • Refunds are subject to our refund policy and applicable platform policies (Apple/Stripe)
  • We reserve the right to change subscription prices with 30 days' notice

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Staqc and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Remove any copyright or proprietary notices
  • Use our trademarks or logos without permission

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • Fraudulent, abusive, or illegal activity
  • Request by law enforcement or government agencies
  • Extended periods of inactivity

You may terminate your account at any time through your account settings or by contacting us. Upon termination:

  • Your right to use the Service will immediately cease
  • All data associated with your account may be deleted (subject to our Privacy Policy)
  • You remain responsible for any outstanding subscription fees

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components
  • Results obtained from the Service will be accurate or reliable

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless Staqc and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Staqc operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through:

  • Good faith negotiation between the parties
  • If negotiation fails, binding arbitration in accordance with applicable arbitration rules
  • Class action waivers apply to the maximum extent permitted by law

14. Apple App Store Terms

If you access the Service through the Apple App Store, the following additional terms apply:

  • These Terms are between you and Staqc, not Apple
  • Apple is not responsible for the Service or its content
  • Apple has no obligation to provide support or maintenance for the Service
  • In the event of failure to conform to applicable warranty, you may notify Apple for a refund
  • Apple is not responsible for addressing any claims relating to the Service
  • Apple is a third-party beneficiary of these Terms

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • For significant changes, providing additional notice via email or in-app notification

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
